Eastern Health commercial copyright licence

The Copyright Agency licenses the reproduction of works owned by its members (generally authors, journalists, publishers, and visual artists) and members of overseas affiliated reproduction rights organisations.

Eastern Health holds a limited commercial Copyright Licence with the Copyright Agency.

The Copyright Agency licence enables up to 500 Eastern Health internal licensed users to copy, store and distribute copies of third party copyright material.

Extent to which copyright material may be used within Eastern Health

Within the terms of the Copyright Agency licence, Eastern Health licensed users can copy and share third party content within the organisation including journal articles, research papers, books, conference papers and online resources to the extent given below.

Journal articles

  • copy 1 article from an issue of a journal
  • copy other articles from the same issue if on the same subject matter.

Books

  • copy 1 chapter or 10% of pages (whichever is greater)
  • only copy more if a work cannot be purchased within a reasonable time at an ordinary commercial price.

Digital content, including websites

  • copy 10% of pages, words or other components.

Newspapers and magazines

  • cannot be copied as they are excluded from this licence.

How material may be used within Eastern Health

Eastern Health licensed users may:

  • photocopy licensed works
  • scan and make a digital copy
  • print out a digital work
  • e-mail a copy to other internal licensed users
  • make single or multiple copies of articles and library resources for internal licensed users
  • make copies for the purpose of training staff
  • use in internal presentations
  • make further copies of articles supplied by the Library Service for internal licensed users
  • store digital copies of third party work
  • make third party content available on an internal server to internal licensed users.

Eastern Health internal licensed users may not:

  • store content in a systematic way so as to create a library or archive that would substantially replace the need for a subscription, or the need to purchase a work.

Supply of copies to users external to Eastern Health

Supply by Eastern Health licensed users of third party material to users external to Eastern Health is permitted only in the following instances:

  • provision of a single hard copy to a third party
  • supply to regulatory authorities
  • supply to advisors in connection to legal proceedings
  • supply in connection to patent applications.

Content supplied externally must be prominently marked or otherwise accompanied by a notice which states, as a minimum: "Licensed by Copyright Agency. You must not copy this work without permission."

Content must also retain metadata and be reproduced without any changes.
